Registration of Power of Attorney (Online Service) (Online Service)
Overview
While a Power of Attorney (PoA) can be notarized for basic tasks, Registration is a mandatory legal requirement for any PoA that involves the sale, transfer, or management of immovable property. Registration provides the document with permanent public record status and makes it legally admissible in Indian courts and before government authorities like the Sub-Registrar or RERA.
At Vakalatexpert.in , we guide you through the entire registration lifecycle. From ensuring the stamp duty is correctly paid to managing the appointment at the Sub-Registrar’s office, we ensure your PoA is beyond legal reproach.
When is Registration Compulsory?
Under Section 17 of the Registration Act, 1908, and following landmark Supreme Court rulings (including Suraj Lamp & Industries and recent 2025 clarifications), registration is essential if:
The PoA authorizes the agent to sell, mortgage, or gift immovable property.
The PoA is Irrevocable and involves the transfer of “consideration” (money).
The PoA is used to present documents for registration on behalf of the principal.
The PoA is for a term exceeding one year in certain states.
The Registration Process
We simplify the complex bureaucracy into four easy steps:
Drafting & Stamping
The PoA is drafted with specific "Power Clauses" and printed on non-judicial stamp paper. The value of the stamp paper varies by state and the relationship between the parties.
Physical Appearance
The Principal, the Agent, and two independent witnesses must appear before the Sub-Registrar. (Special provisions exist for senior citizens or NRIs).
Non-Relatives
If the agent is not a close relative, many states charge stamp duty based on the maarket value of the property (often 1% to 4%) to prevent the misuse of GPAs for "indirect sales."
Verification & Execution
The Sub-Registrar verifies identities via Aadhaar/Biometrics, after which the document is officially scanned and recorded in the government’s "Book of Records."
Exclusive Frequently Asked Questions (FAQs)
You can draft and pay the stamp duty online in most states. However, physical appearance or biometric verification before the Sub-Registrar is still mandatory in India to prevent identity fraud.
